Resolving your Differences

Collaborative Law

Collaborative law is a relatively new process to resolve family law differences. There is no judge or mediator. Instead, the couple and their respective attorneys meet together, with the goal of coming to an agreement. Both sides agree to fully disclose all assets. They also agree not to use these lawyers for litigation purposes. Both sides may use a neutral expert to determine the worth of the marital estate, or to help with issues concerning the children. Valuation experts, business valuators, and real estate appraisers trained in collaborative law can be called upon as needed. There are also mental health professionals trained in collaborative law who can assist with emotional issues.

Litigation

Litigation is used when the parties do not agree to mediation or collaborative law. Some couples have no choice but to litigate. We advocate to protect you, your property interests, and the interests of your children.

Mediation

In mediation, the couple meets with a neutral third party who helps the parties craft agreements that will be incorporated in the final judgment of divorce. The attorneys are usually not present during mediation sessions. Instead, the spouses return to their attorneys after the mediation session for guidance. This method can be cost effective, but works best when the couple is on good terms with one another and have equal ability to negotiate.
